1. Agreement to Terms

By downloading, installing, or using FastPulse ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and Demolition Studios ("we," "us," or "our").

2. Description of Service

FastPulse is an intermittent fasting tracker application that allows you to:

• Track fasting periods with a timer
• View metabolic fasting zones
• Record fasting history and statistics
• Create custom fasting routines
• Set reminders and notifications
• Track weight progress (Premium)
• Sync with Apple Health (Premium)

3. Health Disclaimer

3.1 Not Medical Advice

The App is designed for informational and tracking purposes only. It is NOT intended to:

• Diagnose, treat, cure, or prevent any disease or health condition
• Replace professional medical advice, diagnosis, or treatment
• Serve as a substitute for consultation with a qualified healthcare provider

3.2 Fasting Risks

Intermittent fasting may involve health risks. You should NOT fast without consulting a healthcare provider if you:

• Have diabetes or blood sugar regulation issues
• Have a history of eating disorders
• Are pregnant or breastfeeding
• Are under 18 years of age
• Have any chronic health condition
• Take medications that need to be taken with food

3.3 Fasting Zone Information

The metabolic fasting zones displayed in the App (Fed State, Fat Burning, Ketosis, Autophagy) are based on general scientific research and represent typical responses. Individual results may vary significantly based on factors including age, metabolism, diet, activity level, and health status.

3.4 Your Responsibility

By using FastPulse, you acknowledge that:

• You are solely responsible for your health decisions
• You will consult a healthcare provider before starting a fasting regimen
• You will stop fasting immediately if you experience adverse symptoms
• We are not liable for any health consequences resulting from your use of the App

4. Eligibility

You must be at least 13 years old to use FastPulse. If you are between 13 and 18, you must have parental or guardian consent. We strongly recommend that minors consult with a healthcare provider before fasting.

5. User Accounts

FastPulse does not require an account to use. Your data is stored locally on your device. If you use Apple Health integration, that data is subject to Apple's terms and privacy policies.

6. Premium Subscription

6.1 Premium Features

FastPulse offers a Premium subscription that unlocks additional features including:

• Unlimited fasting history
• Advanced statistics and insights
• Custom fasting routines
• Weight tracking
• Apple Health integration
• Additional fasting plans (OMAD, 5:2, etc.)

6.2 Subscription Terms

• Subscriptions are billed through your Apple App Store or Google Play Store account
• Payment is charged upon confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device's account settings

6.3 Free Trial

If we offer a free trial, it will automatically convert to a paid subscription at the end of the trial period unless canceled. You will not be charged during the trial period.

6.4 Refunds

Refunds are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies. Please contact them directly for refund requests.

7. Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices
• Use the App in any way that could damage or impair its functionality
• Attempt to gain unauthorized access to any part of the App
• Use automated means to access or collect data from the App

8. Intellectual Property

The App and its original content, features, and functionality are owned by Demolition Studios and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

10. Disclaimers

10.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results from using the App will be accurate or reliable
• Any errors in the App will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DEMOLITION STUDIOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Personal injury or health consequences
• Goodwill or other intangible losses

Our total liability shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Demolition Studios and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Demolition Studios operates, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Demolition Studios regarding your use of the App.
